Since July 2013, the European Union Regulation 1223/2009 has been in force for cosmetic products. According to this regulation, a Responsible Person must be determined for cosmetic products offered in the European Union market. Therefore, in the first step, you need to designate a person responsible for your cosmetic products, as stated in Articles 4 and 5 of the Cosmetic Regulation.
Only cosmetic products in which a legal or natural person is determined as the “responsible person” within the Community will be placed on the market. (Cosmetic Products Regulation No. 1223/2009, Article 4.1)
The Responsible Person is obliged to ensure the conformity of the cosmetic product specified in the Cosmetic Regulation. The Responsible Person must be established in the European Union and have an important critical role. The Responsible Person must ensure the conformity of the products offered to the European Market, assume all obligations specified in the regulation and be the only contact person with the European Union authorities.
